Waiver and Release of Liability:
In consideration of being allowed to participate in any way in the martial arts programs, classes, and related activities (collectively, the “Activities”) offered by Future MMA, I, the undersigned, acknowledge, and agree that:
Acknowledgment of Risks:
I understand that participation in martial arts activities involves inherent risks and dangers, including but not limited to, serious bodily injury, permanent disability, paralysis, and death, which may be caused by my own actions or inactions, those of others participating in the Activities, the conditions in which the Activities take place, or the negligence of the Releasees named below. I acknowledge that there may be other risks and social and economic losses either not known to me or not readily foreseeable at this time, and I fully accept and assume all such risks and all responsibility for losses, costs, and damages I incur as a result of my participation in the Activities.
Health and Fitness Certification:
I certify that I am physically fit and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in these activities. I also acknowledge that it is my responsibility to inform the gym of any health issues that may affect my ability to safely participate in the activities.
Release and Waiver of Liability:
I hereby release, discharge, and covenant not to sue Future MMA, its owners, directors, officers, employees, instructors, agents, volunteers, and representatives (the “Releasees”) from any and all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise. I further agree that if, despite this release, I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the Releasees from any loss, liability, damage, or cost which any may incur as the result of such claim.
Indemnification:
I agree to indemnify and hold harmless the Releasees from any and all liabilities or claims made as a result of participation in the Activities, whether caused by the negligence of the Releasees or otherwise. This includes any loss, liability, damages, or costs, including court costs and attorneys’ fees, that the Releasees may incur as a result of such claims.
Medical Treatment Consent:
I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during the Activities. I understand that I am solely responsible for all costs related to such medical treatment, medical transportation, and/or evacuation. I agree to reimburse the Gym for any such costs incurred.
Photography and Media Release:
I grant to the Gym the right to use any photographs, video, or audio recordings of me taken during the Activities for promotional purposes, including but not limited to, social media, website content, advertisements, and other promotional materials, without compensation or notice. I waive any right to royalties or other compensation arising or related to the use of such media.
Severability:
I agree that this waiver and release is intended to be as broad and inclusive as is permitted by the province of Manitoba. and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
